“xAI cannot operate gas turbines without the required permits,” said Abre’ Conner, the NAACP’s environmental and climate justice director, after the company lost its attempt to dismiss the organisation’s pollution lawsuit on October 30, 2026. The decision keeps a route to court open for communities challenging the power plant supplying xAI’s Colossus 2 data centre, according to the Southern Environmental Law Center, which represents the NAACP alongside Earthjustice.
The plant sits in Southaven, Mississippi, and supplies the data centre in Memphis, Tennessee, according to the allegations set out in Judge Debra M. Brown’s order. xAI relied on a Mississippi environmental agency letter treating its portable, temporary turbines as exempt from permits. Brown found that the letter conflicted with the state’s federally approved air rules and that the turbines did not qualify as mobile sources. The lawsuit alleges construction and operation without required permits; the ruling allows those claims to advance, with penalties and the requested remedies still unresolved.
xAI also argued that allowing citizens to bring enforcement cases under the Clean Air Act was unconstitutional, according to SELC’s account of the decision. The court rejected that argument because people seeking relief for their own injuries were not exercising the federal government’s executive authority. A separate Department of Justice effort to dismiss the case had already failed, SELC said.
The NAACP is also seeking a preliminary injunction, a request for court intervention while the lawsuit continues. SELC said that request remained undecided when it issued its statement. With the dismissal attempt rejected, the organisation can continue pressing for relief over the turbines powering Colossus 2.
